1. Services Provided
The Company provides professional home inspection services in accordance with the applicable Kansas and Missouri Standards of Practice, as required by state law or industry-recognized guidelines.

A home inspection is a limited, non-invasive visual evaluation of readily accessible systems and components of a property at the time of the inspection. Inspections are not technically exhaustive and do not constitute warranties, guarantees, or certifications of condition.

This website is provided for informational, scheduling, and payment purposes only. You agree not to:​​

3. Online Booking

We reserve the right to reschedule due to weather, property access issues, safety concerns, or unforeseen circumstances

A separate Inspection Agreement must be reviewed and accepted prior to the inspection.

4. Online Payments
Online payments are processed through secure third-party payment providers. By submitting payment, you authorize the Company to charge the listed inspection fee and any applicable taxes or disclosed charges.​

Payment does not guarantee inspection completion if access to the property is unavailable

The Company does not store full credit card information on its servers

5. Cancellations and Rescheduling
Cancellation and rescheduling policies are disclosed at the time of booking and may include fees if notice is not provided within the required timeframe.
Failure to provide access to the property at the scheduled inspection time may result in a trip fee or forfeiture of payment, as permitted by Kansas and Missouri law.

6. Inspection Agreements
All inspection services are governed by a separate Inspection Agreement, which defines the scope, limitations, and legal terms of the inspection. In the event of any conflict, the Inspection Agreement controls.

7. Reports and Reliance
Inspection reports are prepared only for the client named in the Inspection Agreement and for the specific property inspected.

Reports may not be relied upon by third parties, including buyers, sellers, agents, or lenders, without the Company’s written consent. Conditions may change after the inspection, and we are not responsible for subsequent developments.

8. Limitations and Exclusions
Unless expressly stated in writing, inspections do not include:​

Code compliance or permitting verification

Environmental hazards (including mold, asbestos, radon, lead, or air quality)

Hidden, concealed, or inaccessible conditions

Future performance or life expectancy of systems

9. Intellectual Property
All website content, inspection reports, text, graphics, logos, and materials are the property of the Company and may not be copied, reused, or distributed without written permission.

10. Disclaimers
The website and services are provided “as is.” While we strive for accuracy and professionalism, we make no guarantees regarding future conditions or outcomes.

11. Limitation of Liability
To the fullest extent permitted by Kansas and Missouri law, the Company’s liability for any claim arising from an inspection or website use is limited to the inspection fee paid.
The Company shall not be liable for indirect, incidental, special, or consequential damages.

12. Governing Law and Venue
These Terms shall be governed by and interpreted under the laws of:​

The State of Kansas for inspections performed in Kansas

The State of Missouri for inspections performed in Missouri

Any legal action shall be brought in a court of competent jurisdiction within the applicable state where the inspection occurred.

13. Dispute Resolution and Mandatory Arbitration
In the event of any dispute, claim, or controversy arising out of or relating to this website, the inspection services, the inspection report, or these Terms (a “Dispute”), the parties agree to resolve the Dispute as follows:

a. Informal Resolution​
Before initiating arbitration, the client agrees to notify the Company in writing of the Dispute and allow at least 30 days for the parties to attempt to resolve the matter informally.
​
b. Binding Arbitration​
If the Dispute is not resolved through informal discussions, the Dispute shall be resolved by binding arbitration, rather than in court, except as provided below.​​

Arbitration shall be conducted in the state where the inspection was performed (Kansas or Missouri), unless the parties agree otherwise.

Arbitration shall be administered by a neutral arbitrator mutually agreed upon by the parties, or through a recognized arbitration organization if agreement cannot be reached.

The arbitrator shall apply the substantive law of the state in which the inspection occurred.

The arbitrator’s decision shall be final and binding, and judgment on the award may be entered in any court of competent jurisdiction.

c. Costs and Fees​
Each party shall bear its own attorneys’ fees and costs, unless otherwise required by applicable law or awarded by the arbitrator.

d. Waiver of Jury Trial​
By agreeing to these Terms, both parties knowingly and voluntarily waive the right to a trial by judge or jury for any Dispute covered by this section.

e. Small Claims Exception​
Either party may bring an individual claim in small claims court, if the claim qualifies, as an alternative to arbitration.
​
f. Time Limit on Claims​
Any claim or Dispute arising out of an inspection or inspection report must be brought within the time period allowed by applicable Kansas or Missouri law, based on the location of the inspection.

14. Changes to These Terms
We may update these Terms at any time. Updates will be posted on this website, and continued use of the website or services constitutes acceptance of the revised Terms.
